Cancellation of Paper Certificates of Title: 100% eConveyancing From 11 October 2021

The Registrar General recently made two important announcements relating to certificates of title within New South Wales.

  • On 11 October 2021, all certificates of title ('CTs') will be abolished, known as 'cessation day'; and
  • From 11 October 2021, paper dealings will no longer be accepted for lodgment and only electronic dealings will be accepted.  

This means that from 11 October 2021, New South Wales will have 100% e-conveyancing.


The Modern Slavery Act – Is Your Entity Required to Report on Risk?

On 1 January 2019, the Modern Slavery Act 2018 (Cth) commenced, heralding a new statutory modern slavery reporting requirement for larger companies operating in Australia.

The Modern Slavery Act requires entities either based or operating in Australia, which have an annual consolidated revenue of more than $100 million, to report annually on the risks of modern slavery in their operations and supply chains, as well as actions being taken to address those risks.  

Other entities based, or operating, in Australia may report voluntarily.

Cyber Security: The Essential Eight Strategies to Protect Your Business

Readers will recall from an article Holman Webb published back in 2018 that the Australian Cybersecurity Centre recommended eight best-practice mitigation strategies (the 'Essential Eight') that organisations should implement as a baseline defence against targeted cyber intrusions, ransomware and malicious insiders.

These strategies may seem relatively straightforward to those working within the IT industry, but the failure of organisations to implement the strategies (including government instrumentalities) has moved the Australian government to consider mandating the implementation of the Essential Eight controls, and requiring all public service entities to implement them forthwith.

Native Title: Protecting Culturally Significant Sites From Development

Recent examples of the damage or destruction of culturally significant Aboriginal sites and artefacts has led to a debate about the most appropriate legal tools for their protection. One recent success story wherein a creation 'story site' on Prince of Wales Island (Muralug) in the Torres Strait was protected from a safe harbour development, demonstrates that the courts are willing to step in and grant urgent protection.

Abolition of the Peak Indebtedness Doctrine for Preference Claims?

The Full Court of the Federal Court recently delivered its judgment in the matter of Badenoch Integrated Logging Pty Ltd v Bryant, in the matter of Gunns Limited (in liq) (receivers and managers appointed) [2021] FCAFC 64.

The decision will undoubtedly have significant implications for the ongoing application of the peak indebtedness rule by creditors and liquidators.
