Pratibha is a Senior Associate in our Insurance group and been with the Holman Webb Team for over eleven years.  She has a high level of experience with regard to insurance, medico-legal and personal injury litigation. 

Pratibha has acted on behalf of Queensland Public Hospitals in negligence claims in respect of obstetrics and gynaecological matters, cerebral palsy (misdiagnosis and failure to diagnose), negligent treatment and surgery claims. 

In addition to her law degree, Pratibha also holds a Degree in Applied Science (Biotechnology) and was formerly a laboratory technician, serologist and scientist for eight years, working for the Red Cross Blood Bank and Sullivan Nicolaides.

Experience

• Acting in defence of asbestos claims for Amaca Pty Ltd, the major defendant in asbestos litigation in Australia, for the past ten years.
• Previously acted on behalf of the Queensland Public Hospital in negligence claims for obstetrics and gynaecological matters, cerebral palsy (misdiagnosis and failure to diagnose) as well as negligent treatment and surgery.
• Instructing Counsel in matters which have ultimately proceeded to Hearing before the Dust Diseases Tribunal of New South Wales, including the decision of Comcare v Amaca (Re: Webber [2019] NSWDDT 2.
• Acted in matters across multiple jurisdictions including Queensland, New South Wales and South Australia.
• Past attendances in the Medical Assessment Tribunal to represent a client for reassessment of the total degree of permanent impairment.  Also appeared in matters on behalf of mid-wives in Australian Health Practitioner Regulation Agency (AHPRA) inquiries.
• Past experiences in workers compensation, public lability and CTP claims where she has acted for both Plaintiffs and Defendants - including Workcover Queensland. Pratibha has a thorough understanding of the Personal Injuries Proceedings Act 2002 (PIPA) and Worker Compensation and Rehabilitation Act 2003 (WCRA).
