About

Lee Pike is a Senior Associate in Holman Webb’s Workplace Relations team.  Her experience has been almost exclusively focused on workplace relations matters, and she has high-level practical knowledge with respect to complex industrial relations matters.

Lee has represented clients throughout Australian courts and tribunals, including the Fair Work Commission, where she has both run hearings from start to finish and successfully appealed decisions, Australian Human Rights Commission, Federal Circuit Court and District Court.

Lee commonly finds herself assisting clients with a wide range of workplace-related matters, including unfair dismissal and general protections claims, general employee disciplinary matters and strategic restructuring/redundancy advice.  Most recently, she has developed a passion for advising employer clients on matters relating to workplace health and safety, as well as Environmental Protection Law.

Lee is experienced in presenting to large groups of clients within a wide spectrum of sectors, including executive management, human resources and payroll.  She has hosted workshops and group panel sessions, as well as bespoke training sessions for staff and management on topical issues.  More recently, Lee has presented at the Governance Institute, as well as at seminars focused on changes to Modern Awards.

Experience

• In the Fair Work Commission full bench decision of Roxana Balgowan v City of Sydney RSL Club, a casual employee brought an unfair dismissal matter where she claimed she was forced to  resigned when no cash-handling shifts were provided until she re-trained in cash handling after a series of cash errors.  The decision at first instance was that the Employer repudiated the contract of employment and terminated her.  Represented by Lee, the Employer was successful in having the decision overturned on appeal, and a subsequent decision determined that the employee  was not terminated and the case was ultimately dismissed.
• In the Fair Work Commission matter of Teena Johnson v Darlington Point Club, Lee was successful in having the application dismissed on the basis that the Applicant had lodged it out of time by mistake.
• In the Fair Work Commission matter of Alison Wilks v Inverell East Bowling Club, Lee successfully defended a small business in arguing that they validly terminated an employee who was encouraging contractors to increase their fees to keep her partner employed, increased the costs to the business where she worked and effectively acted against the best interests of her Employer.
